Part1. Birth Registration
It continues to be concerned that, all children are not systematically registered immediately after birth in mainland China, in part because of existing family planning policies, and that this disproportionately affects girls, children with disabilities and children born in some rural areas.
Birth Registration
The Committee expressed concern about the non-registration of births and asked how access to social services could be ensured. The delegation replied that public security organs promulgated laws and regulations on birth registration with a particular focus on rural areas
☞ 아동들에게 주어져야 하는 Civil rights는 출생신고에서부터 시작된다. 그러나 중국의 산하제한정책과 여아 출생과 장애 아동의 출생경우 신고를 하지 않는다. 지화셩이 1979년 5월 1일부터 한 가정 한 자녀만 낳을 수 있도록 제한하여 2명 이상 자녀를 낳을 경우, 부모가 직업을 잃게 되고 둘째에 대해서는 행정처리(취학 등 제한)가 안된다. 한국 돈 1천 만원 이상의 벌금을 내고 행정절차를 밟을 수 있다. 이러한 문화, 사회적 문제는 아동의 기본적 Economic rights and Civil rights and freedom을 제한한다.
1. Civil rights & freedom
CRC 20조항에서는 모든 아동에 대한 국가의 책임을 명시하고 있다.
Article 20
1. A child temporarily or permanently deprived of his or her family environment, or in whose own best interests cannot be allowed to remain in that environment, shall be entitled to special protection and assistance provided by the State.
2. States Parties shall in accordance with their national laws ensure alternative care for such a child.
3. Such care could include, inter alia, foster placement, kafalah of Islamic law, adoption or if necessary placement in suitable institutions for the care of children. When considering solutions, due regard shall be paid to the desirability of continuity in a child's upbringing and to the child's ethnic, religious, cultural and linguistic background.
하지만 중국 정부는 이와 관련하여 아래와 같은 권고사항을 받고 있다.
Street children

85. While noting with appreciation the efforts of the State party in mainland China, the Committee is concerned at the significant numbers of children living and working in the streets.
86. The Committee recommends that in mainland China, the State party strengthen its efforts related to street children, in particular by:
(a) Undertaking further research into the situation of children living and working in
the streets, and using such research to develop appropriate programmes and policies to reduce the number of street children and provide them with appropriate assistance;
(b) Prioritizing family and community based interventions aimed at reintegrating these children successfully into their families;
(c) Increasing the resources provided to local authorities providing services to street children and their families.
☞ 출생신고가 되지 않는 아이들이 있는데 국가가 그런 아이들에 대한 책무를 다하지 않고 있다.
그로 인해 아동들의 시민권과 자유권이 부여조차 되지 않고 있으며, 이는 곧 한 개인이 한 국가의 일원으로서 존엄성이 보장되지 않음을 의미한다. 이러한 상황에 놓여져 있는 아이들은 조화롭고 균형적으로 발달하기 어렵다. 그렇다면, 위와 같은 권리 침해가 아동 발달에 미치는 영향들 중 인지 발달에 미치는 영향을 살펴보자.
Cognitive Development
- Cognitive processes involve changes in the child’s thinking, intelligence, and language. Cognitive developmental processes enable a growing child to memorize a poem, imagine how to solve a math problem, come up with a creative strategy, or string together meaningfully connected sentences.
☞ Street children can not be included in public education system, so they can not develop proper cognitive ability. As Piaget said, if a child is stuck in one stage, that child is impossible to move to the next development stage. It means that street children do not establish cognitive ability.
