. Introduction
Hedge fund is a private, actively managed fund which invests in various liquid assets by using leverage to maximize investment returns. Until recently, hedge funds were strictly restricted by the authorities. However, in 23rd May in 2011, the authorities revised the FSCMA, the Financial Services and Capital Market Act, to allow the establishment of hedge fund in Korea.
To respond to the change in social environment and attain competitiveness of domestic financial market, the authorities revised the law to the Financial Services and Capital Market Act in the direction of loosening the previous regulation to adopt hedge funds in the domestic market. As the internal factor, changes in socio-economic conditions such as rapidly ageing population triggers increasing demand on various financial products, thereby sparking discussion on the necessity of hedge funds in Korea. Outside Korea, the Asian hedge fund industry has been growing rapidly. According to Eurekahedge, there were only 162 hedge funds in Asia with less than US$14 billion of assets in 1999. Currently there are more than 500 hedge funds with the estimates of hedge fund assets ranging from US$60 billion to $200 billion under management. Such growing Asian hedge fund industry poses new challenges on Korean capital market as it seeks to develop in international financial market.
