본문내용
In the Advisory Opinion on the Legality of the Threat or Use of Nuclear Weapons (International Court of Justice, 1996), Judge Weeramantry opined that nuclear weapon inherently violated both the laws of war and the collective moral values of humanity according to the multicultural origins of customary law that is concerned about the brutalities and dreadful sufferings of war. He cited an instance that through the ages many religious and philosophical idea have all given expression that restrict the unlimited right of making and using weapons, thus strengthening the concept of humanitarian law. However, there has been controversy concerning the discussion whether we should accept such multicultural traditions of religious scriptures as customary law.
