영문초록

A claim regarding a joint tenancy a joint tenancy needs to be asserted by and against all the joint tenants. Otherwise the court must dismiss the case, in which standing is not allowed. When any joint tenants are relieved of the joint tenancy or die, it is debatable whether their interests in the property are automatically taken by the remaining joint tenants through their right or survivorship. Without an agreement among themselves, successors cannot succeed the interests of decedents in the property because all the joint tenants share a confidential relationship, whether they take the property as a partnership or as another joint tenancy. A claim regarding the property is required to be asserted to be asserted by and against all the joint tenants.
