영문초록

We analyze the U.S. regulations on IPR-infringing imports, Section 337 of the Tariff Act of 1930. First, examining the border measure provisions of the WTO TRIPS Agreement, we discuss the development of Section 337 including a GATT dispute case. Then, we examine Section 337 investigation procedures and remedies. Investigation procedures include commencement of investigation, discovery, hearings, initial determination by an ALJ, ITC determination and President`s approval. In addition, the available remedies are limited exclusion, general exclusion, cease and desist order, and temporary relief.
