Non-intervention is a norm in international society. It is illegal under the UN charter 2:4 article for states to intervene in other states’ internal affairs. However, humanitarian intervention is an exception to this and has been frequently used to justify states’ acts in intervening other states’ affairs since the Second World War. Humanitarian intervention is an act that allows interfering in the domestic affairs of another state when citizen’s lives are at stake due to actions by their government. Supporters of humanitarian intervention argue that it is legal and legitimate, referring to the UN charter 2:7 article. The idea of humanitarian intervention is contested because of its links to the principles of sovereignty, non-intervention and non-use of force. Humanitarian intervention poses its test for justification.

A clear definition of humanitarian intervention remains puzzling. Wheeler said “the society of states has committed itself to a human rights culture which outlaws genocide, torture and massive human rights abuse, but those principles of humanitarianism can and do conflict with principles of sovereignty and non-intervention” (Wheeler, p 471).
