특허협력조약
이 조약의 체약국은,과학과 기술의 진보에 기여할 것을 희망하고, 발명에 대하여 법적으로 완전한 보호를 할 것을 희망하며, 수개의 국가에서 발명을 보호하고자 할 때 발명의 보호를 더욱 간편하고 경제적으로 확보할 것을 희망하며, 새로운 발명에 관한 문서상의 기술정보에 대한 공중의 접근을 용이하게 하고 촉진할 것을 희망하며, 개발도상국가의 특별한 필요에 적용 가능한 기술적 해결책의 구득에 관한 입수 용이한 정보를 제공하고 계속적으로 확대하는 현대기술에 대한 접근을 용이하게 하며, 발명의 보호를 위하여 개발도상 국가에서 마련한 국내 또는 지역적 법제도의 효율을 높이기 위한 조치를 채택함으로써, 개발도상국가의 경제발전을 조성하고 촉진시킬 것을 희망하며,제국간의 협력이 이와 같은 목적의 달성을 더욱 용이하게 할 것임을 확신하여, 이 조약을 체결하였다.
총 강 Introductory Provisions
제 1 조 동맹의 설립 Establishment of a Union
1) The States party to this Treaty (hereinafter called "the Contracting States") constitute a Union for cooperation in the filing, searching, and examination, of applications for the protection of inventions, and for rendering special technical services. The Union shall be known as the International Patent Cooperation Union.
(1) 이 조약의 당사국(이하 "당사국"이라 칭함)은 발명의 보호를 위한 출원의 제출, 조사 및 심사에 있어서의 협력 및 특별한 기술용역의 제공을 위한 동맹을 구성한다. 이 동맹은 국제특허협력동맹이라 한다.
(2) No provision of this Treaty shall be interpreted as diminishing the rights under the Paris Convention for the Protection of Industrial Property of any national or resident of any country party to that Convention.
(2) 이 조약의 어떠한 규정도 공업소유권의 보호를 위한 파리협약당사국 국민 또는 거주자의 동협약상의 권리를 축소하는 것으로 해석되지 아니한다.
